1. Parties
This Distance Sales Agreement is established between the Seller and the Buyer who purchases the service, regarding the digital subscription service offered electronically.
Buyer:
The user who purchases the service. Identity information is recorded in the system at the time
of the order.
2. Subject of the Agreement
The subject of the agreement is the determination of the scope, price, payment conditions, the rights and obligations of the parties, and the withdrawal/refund conditions of the digital software/subscription services offered by Localghost. This agreement is subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
3. Service Fee and Payment
The service fee is the amount specified on the order/subscription screen. Payment is collected through the contracted payment infrastructure. Subscription renewals take place periodically according to the selected plan.
4. Delivery and Performance
- 4.1. The service is provided in a digital environment; no physical delivery is made.
- 4.2. After payment confirmation, account access is opened and performance begins.
- 4.3. The Buyer accepts that they have read and approved the preliminary information electronically.
- 4.4. In case of technical malfunctions, the Seller re-provides the service within a reasonable time.
5. Right of Withdrawal
Pursuant to Law No. 6502 and the Regulation on Distance Contracts, the consumer may not have a right of withdrawal in contracts relating to intangible goods that are performed instantly in the electronic environment. The Buyer accepts that the right of withdrawal may be eliminated once they consent to the performance of the digital content and performance begins.
In this context, in particular the provisions of the Regulation on Distance Contracts Article 15/1-(ğ) (services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer) and Article 15/1-(h) (services whose performance has begun with the consumer's approval before the expiry of the right of withdrawal period) apply.
6. Rights and Obligations of the Parties
The Buyer agrees to use the service in accordance with the law; and the Seller agrees to exercise the necessary care to keep the service technically accessible. Account security is the responsibility of the Buyer.
7. Dispute Resolution
In disputes arising from consumer transactions, consumer arbitration committees and consumer courts are competent according to the monetary limits determined each year by the Ministry of Trade. The mandatory mediation as a precondition for litigation provisions under Law No. 6502 Article 73/A are reserved.
Important Note: In digital services, the right of withdrawal/refund after performance has begun may be limited or excluded within the scope of the exceptions specified in the legislation.
